TERMS & CONDITIONS

In the following terms & conditions, “the photographer” shall mean Natalie Hamilton, trading as NH Photography Studio. “The clients” shall be those persons defined as individuals purchasing photography services from NH Photography Studio. The clients cannot vary these terms & conditions unless the photographer expressly agrees to such conditions in writing.

COPYRIGHT

The copyright Designs and Patents Acts assign the copyright of the images to the photographer.

DISPLAY

The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and generally promote the business in advertising, brochures, magazine articles, websites, sample albums, Etc.

CREATIVE LICENSE, COVERAGE, AND REPRODUCTION

i. Photographs taken during the event will be at the photographer’s discretion although every effort will be made to comply with the client’s requirements.
ii. Special requests are not binding instructions, although every effort is made to comply with the client’s wishes. The Photographer/s will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location, or group arrangements due to changes in weather and the availability and willingness of subjects.
iii. Due to various lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs.
iv. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs not produced due to technical failure.

PAYMENT

i. A non-refundable booking fee of 50% of the total booking cost will be paid upfront before services begin, as well as full acceptance of the terms and conditions. The booking fee will be deducted from the client’s chosen package cost when calculating the final balance due.
ii. Payment in full of the remaining balance will be due before the client is given full access to their gallery, along with any additional prints or digital copies.

CANCELLATION FEES

i. If the client(s) should have to cancel a booking, the following cancellation fees will become due immediately upon said cancellation:
ii. Cancellation from the booking date with less than two weeks’ notice, the 50% required booking fee will be non-refundable, with nothing additional due.
iii. Cancellations of more than two weeks’ notice until the booking date will be provided with a full refund.

DELIVERY

The photographer will endeavor to deliver digital files as quickly as possible. However, this could take up to 2-3 weeks.
